Terms of Service

Please read my Terms of Service carefully. All clients (past and future) are bound to the contents of this TOS. Please note that these Terms are subject to change without prior notice.

By commissioning me (the Artist), you (the Client) have read, understood and agreed to the following:


  • This is a commission for Digital Art for Personal Use only.
  • I will produce a digital Artwork based on your specifications in my art style.
    • Please provide as much detail as possible. References and character sheets are most welcome.
    • Any changes you request due to not being specified in the commission details will be counted as a Revision and may result to an additional fee.
  • I WILL NOT draw: NSFW, Gore, Furry
  • I reserve the right to refuse or cancel a commission.
  • Price depends on the complexity of the commission.
    • I may charge more for extra details, characters, props, backgrounds and revisions.
  • Turnaround time is around 1-2 months.
    • This is a rough estimate. Depending on the complexity of the commission, it could be shorter or much longer.
    • In case a delay is unavoidable, I will let you know as soon as possible.
  • Final artwork will be in digital format: 300 dpi, A4 size, JPG file
    • Please let me know if you need a different size and/or file format.
    • This is not a physical product and will not require shipment.

PAYMENT

  • Payments are made through Paypal in USD.
  • Payment is Upfront.
    • Commissions lower than 100 USD will require 50% Partial payment.
    • Commissions over 100 USD will require at least 25% Partial payment.
    • The Partial payment is a Non-refundable deposit.
    • I will only start working on the commission once I receive payment.
  • Payment must be completed before I send the final Artwork.
    • The remaining half and any additional fees must be paid before you can receive the final Artwork.
  • Please be prompt in sending payments.
    • I will send a reminder if there is no payment received after one week.
    • If I receive no response after one more week since my last reminder, I will assume you are no longer interested and consider the commission as cancelled by you.

WORKFLOW

  1. Rough sketch / thumbnails
    • I will create a rough sketch or a set of thumbnails based on your commission details.
    • The sketch will focus on the composition of the artwork.
    • I will request for your feedback and/or have you select which of the sketches to use moving forward.
  2. Clean sketch
    • I will then create a refined version of the earlier sketch and include details.
    • Once again, I will request for your feedback and make the neccessary changes.
  3. Color sketch
    • The Artwork would have line art and/or flat colors at this stage.
    • You may request up to three minor revisions.
    • If the revision is due to a mistake on my part, then that revision will not count.
  4. Final artwork
    • I will update you with a low-res version of the completed artwork.
    • Revisions at this stage will be charged a fee unless it is due to a mistake on my part.
    • Payment must be completed before I send the hi-res Artwork.

REVISIONS

  • You can request revisions provided it does not involve completely changing the drawing from what was originally instructed.
    • If you wish to change the original instructions, I may charge an additional fee as I see fit.
  • You may request up to Three Minor revisions during the Color Sketch stage.
    • Minor revisions refer to simple changes -- for example, changing the eye color from what was originally instructed.
  • Minor revisions past the limit (3) are subject to an additional fee.
  • Major revisions are subject to an additional fee.
    • Major revisions involve redrawing a huge portion of the artwork -- for example, changing the pose or clothing of the character.
  • If the revision was due to a mistake on my part, that revision will not be counted or charged.

CANCELLATION AND REFUNDS

  • I will issue a 100% refund if the cancellation occurs within 24 hours after payment OR before I could begin working on the commission, whichever comes first.
  • If for whatever reason I can no longer work on the commission:
    • I will issue a 100% refund if I have not started working on it
    • OR I will issue a refund minus a fee corresponding to the amount of work I have done.
  • There are no refunds once I have started working on the commission.
  • If you would like to cancel the commission, please let me know as soon as possible.
  • If you have any problems regarding refunds, please contact me first so that we can resolve the issue.
    • Depending on the situation, I may or may not issue partial refunds.
  • Refunding or cancelling the commission means you no longer have any right to use the commission or Artwork.
    • I reserve the right to use the Artwork, including the sketches and comps, however I want.
      • For example, making and selling prints of the Artwork.

COPYRIGHT

  • I retain all rights to the Artwork.
    • This includes, but not limited to, the sketches and comps.
    • This includes the right to reproduce the Artwork.
    • I will not claim your original characters / design as my own.
  • I reserve the right to display work in progress (WIP) photos and the Artwork anywhere, such as my social media accounts and portfolio, or a published material such as an artbook.
    • This includes posting videos (live stream / recording) of the drawing process.
    • Please let me know if I should post only after a certain time -- like, the commission is a gift that shouldn't be revealed yet.
  • You are not allowed to claim the Artwork as your own.
  • You may post the Artwork online as long as you include proper credits.
  • The Artwork is for Personal Use only.
  • You may print the Artwork as long as it is for personal use.
  • You are not allowed to make money off the Artwork in any way.
  • You are not allowed to remove my signature from the Artwork.
  • You are not allowed to alter or modify the Artwork without my permission.
  • You are not allowed to use the Artwork in any block-chain, nft, crypto related tech.
  • You are not allowed to use the Artwork for AI training and the like.
